KuKu Luxury Authentication Policy

This policy establishes how luxury and designer items are handled on KuKu to ensure transparency, trust, and regulatory compliance, while clearly defining the responsibilities of sellers, buyers, and KuKu. KuKu operates as a marketplace facilitator and does not authenticate luxury goods unless a buyer explicitly purchases a third-party authentication service.

1. Seller Responsibility for Authenticity

  • Sellers listing luxury or designer-branded items (including but not limited to bags, shoes, accessories, and apparel) are solely responsible for ensuring that the items they list are genuine and not counterfeit.
  • During the listing process, sellers must explicitly confirm that the item is authentic.
  • Sellers are strongly encouraged to upload clear images and documentation where available, including:
  • Serial numbers, brand tags, holograms, or authenticity cards
  • Original receipts, proof of purchase, or certificates of authenticity
  • Original packaging, if available
  • Submission of false, misleading, or counterfeit items constitutes a serious policy violation and may result in account suspension or permanent removal.

2. KuKu Quality Check (QC) Scope

  • All QC requested items are subject to KuKu's Quality Check (QC) process before delivery.
  • KuKu's QC includes visual and physical inspection only, such as reviewing:
  • Materials, stitching, logos, labels, and serial tags
  • General workmanship and condition
  • KuKu's QC does not constitute authentication.
  • KuKu does not guarantee the authenticity of luxury items unless a buyer has purchased a third-party authentication service.

3. Authenticity Disclosure Labels

Luxury listings on KuKu may be displayed with the following disclosures:

  • “Seller-Declared Authenticity” – The seller has declared the item to be authentic and may have provided supporting documentation. This declaration reflects the seller's statement only and does not constitute authentication by KuKu.
  • “Authenticity Not Verified” – The seller has not provided sufficient documentation, and the item has not been authenticated.

KuKu does not endorse, certify, or verify authenticity unless explicitly stated through a third-party authentication service.

4. Buyer Acknowledgement & Awareness

  • Buyers are encouraged to carefully review listing images, descriptions, and any documentation provided by the seller before purchasing luxury items.
  • By purchasing a luxury item without third-party authentication, buyers acknowledge and accept the associated risk and understand that KuKu's role is limited to marketplace facilitation, logistics, and quality checks.

5. Counterfeit Claims, Disputes & Enforcement

If a buyer raises a claim that a luxury item is counterfeit:

  • KuKu may request additional proof or documentation from the seller.
  • The item may be temporarily withheld from payout or delivery while under review.

If an item is reasonably determined to be counterfeit:

  • The listing will be removed immediately.
  • The buyer will be eligible for a refund in accordance with KuKu's Return & Refund Policy.
  • The seller may face penalties, including listing restrictions, account suspension, or permanent removal.
  • KuKu reserves the right to report confirmed counterfeit activity to relevant UAE authorities, in compliance with applicable laws.

All counterfeit-related disputes are handled in accordance with UAE Consumer Protection laws and applicable regulations.

6. Third-Party Authentication Add-On (Future & Optional)

  • KuKu may offer optional third-party luxury authentication services at an additional charge.
  • Authentication results provided by third-party partners are final and binding for dispute resolution purposes.
  • KuKu does not influence, alter, or override third-party authentication outcomes.

7. Disclaimer & Limitation of Liability

  • KuKu acts solely as a platform facilitator and logistics coordinator.
  • KuKu is not the certifier of authenticity for luxury items unless a third-party authentication service is explicitly purchased by the buyer.
  • To the fullest extent permitted by law, KuKu disclaims liability for counterfeit claims arising from seller misrepresentation, except where negligence or willful misconduct by KuKu is proven.

8. Updates to This Policy

KuKu may update this Luxury Authentication Policy from time to time to reflect operational, legal, or regulatory changes. Continued use of the platform after updates constitutes acceptance of the revised policy.
